ICDPASO First Commercial Mediation Case (Good Offices Consultation Rules) Successfully Concluded

The first case of the International Commercial Dispute Prevention and Settlement Organization (ICDPASO) applying the Dispute Prevention Rules -Good Offices Consultation Rules was recently successfully concluded. Through the innovative application of the flexible and efficient mechanism established under the Good Offices Consultation Rules, the case successfully resolved a sales contract dispute arising from the detention of goods at an overseas transit point. The case was referred to ICDPASO by the embassy in China of the country where the party are located. In accordance with the new rules, ICDPASO initiated the good offices consultation procedure and, as an international neutral third party, guided the parties in rebuilding mutual trust. Ultimately, through multiple rounds of coordination and consultation, the parties reached a settlement agreement involving “partial compensation + preferential terms for future procurement.” On the one hand, this effectively prevented the further escalation of the dispute and losses; on the other hand, it transformed a straightforward claim for damages into an opportunity to upgrade commercial cooperation, thereby truly achieving the goal of “turning conflict into amity.”
This case has further enriched ICDPASO’s practice in international commercial mediation, verified the effectiveness of efficiently and professionally resolving international commercial disputes, and also marks the successful transition of the commercial dispute prevention and resolution rules matrix being developed by ICDPASO from institutional design to practical application. It has further strengthened the confidence of international commercial entities in an international organization jointly initiated by legal and business institutions from multiple countries to prevent and resolve disputes, and has demonstrated ICDPASO’s positive role in optimizing the international business environment and promoting cross-border economic and trade cooperation.”
